If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

• You are responsible for maintaining the security of your account and credentials.
• You agree to provide accurate account information and to promptly update any information that changes.
• You are responsible for all activity occurring under your account.

Operant allows users to create, train, manage, and use custom computer vision and object detection models.

Features may change, be added, modified, or removed at any time without prior notice.

We do not guarantee that any feature will remain available indefinitely.

You retain ownership of images, datasets, annotations, models, and other content you upload to the Service ("User Content").

By uploading User Content, you grant Operant a limited license to store, process, transmit, and use that content solely for providing and improving the Service.

You represent and warrant that:

• You own or have permission to use all uploaded content.
• Your content does not violate any law or third-party rights.
• Your content does not contain malicious software.

Models generated through the Service are created using machine learning techniques and may produce inaccurate or unexpected results.

You are solely responsible for evaluating the suitability of any model, prediction, detection, classification, or output produced by the Service.

Operant makes no guarantees regarding:

• Accuracy
• Reliability
• Performance
• Fitness for a particular purpose

You may not:

• Violate any applicable law.
• Attempt to gain unauthorized access to the Service.
• Interfere with or disrupt the Service.
• Upload malware, viruses, or harmful code.
• Reverse engineer the Service except where permitted by law.
• Use the Service for illegal surveillance or unlawful activities.
• Use the Service in life-critical, medical, emergency response, aviation, military, or other safety-critical applications.

Certain features may require the purchase of credits, subscriptions, or other paid services.

All purchases made through Apple's App Store are governed by Apple's payment and refund policies.

Credits are non-transferable and have no cash value unless otherwise required by law.

The Service, including software, designs, logos, trademarks, and related materials, is owned by Alien 3D Technology, LLC and protected by applicable intellectual property laws.

These Terms do not grant you ownership of any Operant intellectual property.

The Service is provided on an "as available" basis.

We do not guarantee uninterrupted operation, uptime, availability, or error-free performance.

Maintenance, upgrades, outages, and technical issues may occur at any time.

We may suspend or terminate your access to the Service if:

• You violate these Terms.
• Your use creates security, legal, or operational risks.
• We discontinue the Service.

You may stop using the Service at any time.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPERANT DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALIEN 3D TECHNOLOGY, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF:

• The amount you paid to Operant in the preceding twelve months; or
• $100 USD.

Your use of the Service is also governed by our Privacy Policy.

We may update these Terms from time to time.

Updated Terms become effective when posted.

Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

These Terms shall be governed by the laws of the State of California, United States, without regard to conflict of law principles.

Apple Inc. is not responsible for the Service, its maintenance, support, or any claims relating to the Service.

Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
